    divorce or annullment with a missing person?

    I'm writing because my husband has been missing for a year and I'd like to know how to do to divorce him my story: I'm an italian citizen, entered in the US through the visa waiver in October 2006; in the middle of november I've met a man, Raymond Dion Ochoa, we fell in love and I stayed for him in the US more than I could legally stay to marry him. We married on the 12th of March in New Orleans After less than a month later his mother died, he went nuts, he began drinking heavily using drugs and to top it all of he began having an affair I beared all of this with difficulty, then in the beginning of May, after his short affair ended and little before we wereto get a house together by ourselves he stole the money from the hostel he was working at and disappeared I couldn't make sense of it, the only explanation I can think of is that maybe he had to pay off somebody for the drugs I don't know though he left me there like that devastaded and I decided to leave the US, since at that point, even if he had returned I wouldn't have wanted anything to do with him and because of the fact that we were still waiting for the marriage certificate since it takes 8 weeks, and the immigration practices were non existent At the moment I'm back in Europe I'd like to know it it were possible to annull the marriage for abandonment or for some other reason like the fact that I haven't seen him for nearly a year now for what I know the police hasn't found him yet something that was strange and I don't know if this could helpis when we went for the marriage certificate he told me that he had been married for 5 days once,(only because he wanted to give his surname to his daughter but that when he realized that his wife at the time didn't want to give his name anyway he annulled the marriage) and he was vehement with me about not wanting on his marriage license that he had an annullment, saying that there was no trace of it, so did he lie on the license? I don't know whether that could play in my favor now thank you and sorry for the long post

    If you can not find any record of him, and can show that you have been living without him, most states will do a divorce for abondement for most the times a year, sometimes it takes 2 years,  But with no record of him or information, they may clear it, that is my opinion, the best thing to do is find a lawyer within your area Europe and see if they can legally annull the papers.
