    child support

    Me and my wife are currently seperated right now but not divorced yet. We are trying to settle child support payments out of court. the cild support website says i should be paying around 470 a month. My ex is asking for 500. do i have to start paying that before we divorce or is child support only given when the divoce goes through?

    First off I would not settle the payments out of court....usually child suppot is based on the amount of BOTH parents incomes in the research I have read, even though they take the payment from how much the paying spouses income is, they also look to see how much the other spouse is bringing in and the number of children.  If there is already a fuss on what she wants and what your research has told you, please go through your court system, and get this in paper work.....now it is important if there are divorce papers started, or your just seperated, to go ahead and be looking at what you need to be paying, you do not want to let her hit you for back child support, even though in a lot of cases they will allow those in payments.  I ended up finding a lot out about child support through research for my brother and both of his divorces. Keep a record of everything you pay her, EVERYTHING, also things such as medical and schooling will all need to be looked at in the divorce for child care, so it is really important to let your lawyers that are working with you help you with all of this. I also like to remind people to take the time to research and find a good lawyer, you do not want to end up in court again, but this is a matter that needs to be settled in court and through lawyers.
