    Hello-

    In 2006 I was informed by the IRS that I was married to my ex-boyfriend because when we filed taxes in 2002 the company that we used filed my taxes as jointly instead of using him as a dependent. During that time he was a college student and i was a college graduate that was helping him pay for college.

    Today during a conversation regarding our son getting hurt at daycare....the injury lawyer that he spoke with informed him that because we were divorced and the child lives with me and because there is no child support or joint custody orders that he does not have any custody rights to our son.  Is this true?  If so.. what do we need to do so that he can have custodial rights again?

    You definitely need to seek getting a lawyer to draw up child support and custody papers, has he ever paid child support? If not you can possibly get him for back pay also, and does he have anything to do with the child?  Yes he should be paying child support, men do not realize it’s for they care of their children!

    He does provide for his child and he sees him everyday.  It's just that we are no longer together.  So does he not have custody of our son?Do we need to go back to the lawyer that filed the divorce to amend the custody? In order for us to have joint custody would he have to pay child support because when we got the divorce I declined child support because he does care for his child and we needed it for the IRS. I have never had a problem with him providing anything for our child.

    I would seek the lawyer that first drew up your papers about this matter.  Another is if there was never custody of the child or child support wrote up with the papers, there was nothing ever settled.  You can go back to a lawyer though and get parental rights set up along with child support, and most likely help with medical bills.
