Information on Arizona Divorce.

Arizona Divorce.

Divorce in Arizona can get a little tricky but that is due to the change in divorce and the marriage law in 1998. So there is 2 types of marriage.  There is Standard and Covenant marriage.  The standard marriage was laws adapted before 1998 so its a little easier to get a divorce if you were married before 1998 in Arizona.  Basically if you are still in the standard marriage laws you can say the marriage is irretrievably broken, but if you were married after 1998 the laws changed making it a little more difficult to get a divorce.  You must have proof that your spouse did one of the following in the marriage for the divorce to continue.

1.  You must have proof that there was adultery in the marriage.  Then the divorce process may begin.

2.  Proof that your spouse was convicted of a felony and will be sentenced to prison or death.  Then the divorce process can begin.

3.  Your spouse must have abandoned you for up to one year and you must have proof that you were on your own.  Then the divorce process can begin.

4.  Any abuse to the children or yourself with proof.  Then the divorce process can begin.

5.  The legal separation up to 2 years.  Proof that it was a legal separation.  Then the divorce process can begin.

6.  Alcohol or drug abuse with proof  you tried helping your spouse receive help with no prevail.  Then the divorce process can begin.

7.  When both spouses agree completely on the divorce and everything in it.

Divorce in Arizona is referred to as the petition for dissolution of a marriage.  You must have lived in Arizona for 90 days and follow their divorce laws.  The divorce will have to be filed in the county that you and your spouse are in.  So the legal divorce process will begin when your spouse files for a divorce, with the Superior Court.  There is a 60 day waiting period for the divorce after your spouse responds to the divorce papers they were served with.
