Husbands Pension In Divorce.
We have discussed this just a little bit in divorce, about receiving your husbands pension. So many people tend to over look this in a divorce, but it is only fair in many cases that a spouse receives her husbands pension in a divorce. Many divorce cases have been reopened due to pension that was not received in a divorce, because a spouse had no idea they were entitled to receiving it, OR even knew anything about their husbands pension. This is another reason I stress on finding a good divorce lawyer, I am not sure how many times I will say that through out my life :) as I sit here smiling about it, and I know the people that read my divorce blogs probably are going to laugh at that statement, because it is something I do stress in about every blog the importance of a good divorce lawyer, it is something they will pick up on, is that you can receive a husbands pension in a divorce.
Of course with anything there are terms, to how and when and why you can receive a husbands pension in a divorce, such as duration of the marriage, etc, so if your divorce lawyer does not mention it, please do, to see if you are entitled to your husbands pension. So that being said, and again I think of how nice it is to be able to get information, ask questions, and know a little bit before you seek out your divorce lawyer, at least you have the information to ask. Why I love giving the information.
If your divorce is over and now you have learned you could have received your part of your husbands pension in a divorce, a divorce case can be reopened, of course you need to have all your information together its important, and you will have to file your quality motion papers, they of course will need to be very detailed for the divorce case being reopened. Then you will have to have a legal brief to convince the divorce courts to reopen it. Then you will also submit a new CIS for the courts.
