Divorce, Dividing Property and Debt in New York.

Divorce is never easy, and dividing your property and debt in a divorce sometimes is one of the hardest things you do.  Marital property is what it is referred to in New York but remember just like most states, New York also has not all property is marital property.  I can say it a thousand times over, its always good to keep all info you have on things, especially inheritance, money from a separate business, always always keep your information separate and handy in a safe place.  You may think you will never get a divorce but things happen.  Divorce happens.

So here is a look at what is not marital property in a divorce in New York IF you keep your stuff separate from marital property!   Also keeping documents and all papers on your separate property if combined can sometimes help in the divorce.

* Now anything that you had before you were married is your property, which can be furniture, things from family,  Also inheritance, and gifts, but again keep those separate, do not put them in a joint account.

* If you have money that is produced from a separate investment or business, that brings in an income you get, but again remember not to commingle that money, it can come back to bite you in a divorce.

Now when getting a divorce, the divorce courts do look at some things, so that things can be split equally and fairly in the divorce, so here lets take a look at what divorce courts take into consideration when splitting property and debt in a divorce.

1.  Divorce courts take a look at what both spouses are making at their jobs, helps to determine who can pay for what in a divorce.

2.  The divorce courts take a look at how long the marriage was.

3.  The divorce courts look at health and if there is any medical cost for one spouse or both, any special needs.

4.  The divorce courts look at who will be the custodial and non custodial parent in the divorce.

5.  The divorce courts look at if there will be a loss of a pension in the divorce.

6.  The divorce courts take a look at if a spouse is going to be receiving alimony in the divorce.

7.  The divorce courts look at if there is any tax consequence from the divorce.

The divorce courts look at if any of the spouses did any property damage during the divorce.

There are still many more things and factors that are looked at in New York divorce, New York divorce seems to be one of the hardest states when it comes to getting a divorce and the process of it.
