Indiana Debt Division Information.

Today we are going to discuss Indiana's debt division.  This is where the divorce courts, split up the spouses, marital assets, which are debts and property that are acquired during the marriage.  Not everything is considered to be marital assets.  So what are those things?  They can be inheritance, gifts, and things that you had before you were a couple, also business that brings in separate money, but you need to be careful, not to commingle those with the marital assets, or the divorce courts can consider them to be marital assets in the divorce, and split them. Remember it is always important to keep all documents and information on your property, those help in the divorce process, and debt division.  The divorce courts try to split property as fairly as possible, how the marriage is ended, or things that brought the marriage to an end in divorce, are things that are not considered when the divorce courts are separating property up, and splitting things equally is not always what happens, there are different factors that the divorce courts do look at when being just and reasonable with marital assets.  Here is a list of factors of how the divorce courts help make their decision in Indiana.

1.  What each spouse brought into the marriage, each spouses contribution to the marriage, before it ended in divorce.

2.  The divorce courts look at each spouses acquired property, before the marriage, or even during the marriage, what I discussed in the first paragraph to see what property was maybe a gift, or inheritance.

3.  Each spouses circumstances, will one spouse need to stay home with a child, being the custodial parent.

4.  The conduct of each spouse during the marriage and the divorce process, now this is not what made the marriage end, but if it relates to the splitting of the marital assets.

5.  Each spouses earning capabilities, and how they will take care of themselves after the divorce.

A divorce process is never easy, but I can not stress enough, how important it is to keep all records and information, to be able to give to the divorce lawyers, for the courts in the divorce process of selecting the marital assets.
