Rhode Island Debt Division Information.

In Rhode Island everything that you acquire during a marriage, assets, debts, all of these are considered to be what is called marital property, just as in most states. Marital property is to divided equally in a divorce.  If spouses can not divide property between themselves in a divorce, then the divorce courts step in to help with dividing the debt and property, now not all property is not considered to be marital property in a divorce.

Here is a list of what is not considered to me marital property in a divorce.

1.  Things you had before the marriage, property that was acquired before the marriage, is not considered to be marital property in a divorce.

2.  Any income that is produced by a separate investment, now the important thing is not to commingle it with marital property, then it could be harder to get it in a divorce.

3.  Any property that is inherited through family, even during the marriage as long as it is willed right to you, again do not commingle it with marital property, or it can be hard to get it in a divorce.

Another important step in all of this, is make sure you keep all your info on your property and investments that were separate.

So when courts are deciding who gets what in a divorce, here is a list of what factors are weighed in on who gets what.

1.  How long was the marriage before the divorce.

2.  The over all actions and conduct of each spouse during the marriage and also the divorce, all of this is looked at.

3.  What each spouse put into the marriage, now even a homemaker is considered in this, does not have to be contributions of just paying the bills.  Those are all factored in when dividing the property in a divorce.

4.  The overall health and age of each spouse in the divorce.

5.  The amount that each spouse makes separately in income.

6.  The occupation or the employability of each spouse is also factored in on dividing the property and debt.

7.  Future opportunities of each spouse of income and assets after the divorce.

8.  Earning abilities of each spouse, to be ale to own, rent and pay bills. and the best interest of the children in the divorce.

9.  If there was any wasteful dissipations of any assets in the divorce.

9.  If there are any other other factors that van be relevant.

Everything is looked at in dividing the debts and assets, to even if one spouse will be able to pay for it and be able to take care of children in the divorce.  In a divorce the courts and judges always try to equally divide the debt and property.
